How Evictions Work for Lauderhill Properties
Lauderhill evictions follow Chapter 83 of the Florida Statutes, the same statewide law that applies everywhere in Florida. Since 2023, state law has preempted most local landlord-tenant rules, so there is no separate Lauderhill eviction procedure. Every residential eviction involving a Lauderhill property is filed in Broward County Court, and the Broward Sheriff’s Office enforces the writ of possession.
- Notice. A 3-day notice for unpaid rent (not counting weekends or legal holidays), a 7-day notice for other lease violations, or a 30-day notice to end a month-to-month tenancy.
- Complaint. If the tenant does not comply, the landlord files a complaint for possession in Broward County Court.
- Response. The tenant has five days, not counting weekends and legal holidays, to respond and, in most cases, to deposit the rent claimed into the court registry.
- Judgment and writ. After judgment, the clerk issues a writ of possession. The Sheriff posts it, the tenant has 24 hours to leave, and the landlord must be present with a locksmith when the Sheriff finalizes the lockout.
For Lauderhill Landlords
We prepare and serve notices, file and prosecute eviction cases, pursue unpaid rent, and handle holdover tenants and lease violations. Many Lauderhill rentals are in condominium and HOA communities, where association rules on leasing, tenant approval and use of common areas can affect how a lease is enforced. We review those documents along with the lease before the first notice goes out, because a defective notice is the most common reason eviction cases are dismissed. For Lauderhill Tenants
If you have received an eviction notice or summons, the deadlines are short. A tenant who does not respond within five days, or who raises defenses without depositing the rent claimed into the court registry, can lose by default. We review the notice and the lease, identify defenses such as improper notice, retaliation or the landlord’s failure to make repairs after written notice, and work toward the best available outcome, including negotiated move-out dates. See our tenant attorney page for more.
Frequently Asked Questions
How long does an eviction take in Lauderhill?
An uncontested eviction for unpaid rent often finishes within three to five weeks of the notice. Contested cases and service problems take longer.
Does Lauderhill have its own eviction rules?
No. Florida’s statewide law controls residential evictions, and Lauderhill cases go through Broward County Court like the rest of the county.
Can a Lauderhill landlord change the locks on a tenant who will not pay?
No. Changing locks, removing belongings or shutting off utilities without a court order is prohibited and exposes the landlord to damages. Possession has to come through the court and the Sheriff.
