The Case

South Florida lender Monroe Capital and real estate firm Witkoff Group are facing a $125M lawsuit for allegedly taking illegal ownership of the Shore Club Hotel and Hotel Sues for $125M In Illegal Ownership Case. The Group’s CEO, Steven Witkoff, is being accused of allegedly scheming to obtain ownership of the 309-room building, which has been closed since the COVID-19 pandemic in 2020.

SC Phillips Clark, LLC was to offer the building and property at 1901 Collins Avenue in exchange for half the ownership stakes. The agreement was that HFZ Capital Group, the lead developer of the project, would be absorbing costs.

The lawsuit alleges that when HFZ defaulted on the $100M mortgage, Monroe Capital and Witkoff Group used this to their advantage and went against the original agreement between the two parties. This allowed the plaintiff to file a lawsuit against Monroe and Witkoff, seeking damages for the illegal assumption of ownership of the property.
